Furnitex Limited - Terms and Conditions

This document outlines the terms and conditions governing purchases from Furnitex Limited. By placing an order, you agree to these terms. Furnitex reserves the right to modify these terms without prior notice.

1. Delivery and Shipping

1.1. Delivery Restrictions: Furnitex reserves the right to refuse or cancel deliveries to locations with limited access, including but not limited to: permit-required zones, campsites, construction zones, churches, country clubs, private estates, farms, military/government buildings, storage facilities, and universities. If your property requires an access code, please provide it during scheduling. Missed appointments due to access issues will incur a BDT 5,000 cancellation fee.
1.2. Delivery Options:
1.2.1. Dhaka: Store Pick-Up, Home Delivery (No Setup), or Full-Service Delivery & Setup.
1.2.2. Outside Dhaka: Delivery to Parcel Service (No Setup). Customer is responsible for parcel delivery costs.
1.2.3. International: Furnitex is working on providing international delivery options.

1.3. Home Delivery (Dhaka): Free for orders over BDT 5,000 (ground level, no setup).

1.4. Home Delivery (Outside Dhaka): Delivery to designated parcel office. Fees vary by location and order.

1.5. Full-Service Delivery & Setup (Dhaka): Includes assembly, placement, and trash removal (ground level). Haul-away of old furniture is not included in any delivery option.

1.6. Delivery Estimates: Furnitex will provide an estimated delivery date within 72 hours of order placement. These are estimates, not guarantees. Furnitex will communicate any changes. Tracking numbers will be provided when available.

1.7. Separate Shipments: Shipping fees cover a single shipment. If items are backordered, customers can choose separate shipments (with additional fees) or wait for a single shipment.

1.8. Address Corrections: Furnitex is not responsible for incorrect addresses. Address corrections after scheduling will incur a BDT 5,000 fee. Proof of address may be required.

1.9. Delivery Scheduling: Furnitex will contact customers when orders are ready. The shipping company will then contact customers to schedule delivery. Failure to respond within 24 hours may result in storage fees, which will be passed on to the customer.

1.10. Shipping Damage: Inspect all items upon delivery before signing the receipt. Report any damage immediately. Refuse delivery if damage is irreparable. For drop-off services, inspect packaging before signing.

2. Order Acceptance and Payment Processing

2.1. Payment: Accepted payment methods: Credit card (Visa, MasterCard, American Express), Check card (Visa, MasterCard, American Express) (payment within 24 hours or order is cancelled), Cash on Delivery (Dhaka only). Furnitex does not accept checks.

2.2. Order Verification: Furnitex Limited reserves the right to verify all orders, including phone verification for high-value orders or to confirm billing information. Orders may be placed on hold or cancelled if verification fails.

2.3. Payment Processing: Furnitex Limited may take additional verification steps for credit card payments to prevent fraud. Orders with failed payment verifications will be cancelled.

3. Returns and Exchanges

3.1. Returns: Accepted within 72 hours of delivery for most items in original packaging and unassembled condition. Customer is responsible for return shipping costs. A 10% restocking fee applies to all returns, including drop-ship orders. Original shipping and handling fees are non-refundable. Damaged items can only be exchanged for the same item. Returned items will be inspected before refunds are processed. Pick-up fees apply for at-home returns. Initial delivery fees are non-refundable. Refunds for cash purchases will be made in cash or via bank transfer.

3.2. Returning Damaged Replacements: Customers must return the original damaged item (in original packaging) within 3 days of receiving the replacement. Failure to do so will result in a charge for the replacement item.

3.3. Exchanges: Furnitex will replace items damaged during shipping if notified within 24 hours of delivery. Note any packaging damage with the shipper at delivery. Exchanges are not offered for color preferences. Computer displays and lighting may affect product image accuracy.

3.4. Warranty: Furnitex offers a 72-hour replacement warranty for valid reasons.

3.5. Defects: Furnitex may repair or replace parts found to be defective within one year. The following are not considered manufacturer defects: slight color variations due to photography/display differences, slight softening of foam over time, minor size variations due to metric conversion, and pillows.

4. Post-Delivery Cancellation

4.1. Cancellation Charge: After product delivery, if the client wants to cancel the order, they need to pay a BDT 1,000 cancellation charge. This is in addition to any other applicable fees, such as restocking fees and return shipping costs.

5. Service Limitations and Warranties

5.1. Fair Wear and Tear: Furnitex Limited furniture is warranted to be free from defects in materials and workmanship for a period of [warranty period] under normal residential use. This warranty does not cover normal wear and tear, including fading, scratches, dents, or damage caused by misuse, abuse, negligence, accidents, improper cleaning, or commercial use.

5.2. Product Suitability: Customers are responsible for selecting furniture suitable for their intended use and environment. Furnitex Limited is not liable for any damages caused by improper use of furniture, such as using a chair for standing or placing a heavy object on a shelf exceeding its weight capacity.

5.3. Color Variations: Slight variations in color may occur between the product image displayed on the website and the actual product due to factors like photography, lighting, and monitor settings. Furnitex Limited cannot guarantee an exact color match.

6. Customer Support

6.1. Contact Channels: Furnitex Limited offers customer support via phone, email, and live chat during business hours [specify hours].

6.2. Response Times: Furnitex Limited will strive to respond to customer inquiries within [specify timeframe] during business hours.

7. Website Content and Accuracy

7.1. Content Disclaimer: Furnitex Limited strives to provide accurate information on its website, but product descriptions, specifications, and pricing may be subject to change without prior notice.

8. Order Cancellation (Pre-Delivery)

8.1. Orders can be cancelled within 6 hours without a fee. Cancellations after 6 hours incur a 5% processing fee. Orders cannot be cancelled after shipment from the manufacturer to Furnitex or from Furnitex to the customer.

9. Limitations and Qualifications of Sale

9.1. Delivery times are estimates, not guarantees. Furnitex is not responsible for delays beyond its control. No compensation is available for backorders or delays.

9.2. All claims for damage, defects, or mis-shipped merchandise must be made in writing within 48 hours of receipt.

9.3. These terms constitute the entire agreement.

9.4. Full payment is required before delivery. Customer-caused shipping delays may result in a 10% storage fee.

9.5. Measurements, dimensions, finishes, colors, and styles are approximate and subject to change by the manufacturer.

10. Site Errors

10.1. Furnitex reserves the right to correct any errors or omissions (even after orders are placed), including pricing, images, and availability. Prices do not include sales tax or delivery fees.

11. Backorders and Discontinued Stock

11.1. Customers will be notified of discontinued items and offered a cancellation with no restocking fee. Customer approval is required for backordered items before order finalization.

12. Industrial Use

12.1. Products are intended for home or office use only. No warranty is provided for commercial use.

13. Specific Needs

13.1. Contact Furnitex for a consultation before ordering if you have specific needs or preferences.

14. Store Pick-Up

14.1. Requirements: Valid ID and copy of invoice (online) or sales receipt (in-store). If someone other than the purchaser is picking up, they must have the original sales receipt (in-store).

14.2. Timing: Items must be picked up within 2 days of purchase (in-stock) or arrival at the warehouse (backordered). Failure to do so will result in a cancellation with a 40% restocking and storage fee. The remaining balance will be issued as in-store credit.

15. Right to Modify Terms

15.1. Furnitex reserves the right to change these terms and conditions without prior notice.
